What Is the Spanish Democratic Memory Law?

Enacted in October 2022, the Democratic Memory Law was designed to recognize and repair historical injustices. The law includes broad provisions to support memory, justice, and reparations for those affected—and among these, a central provision allows for the restoration of nationality to the descendants of exiled or disenfranchised Spanish citizens.

The law is informally called the Spanish Grandchildren’s Law because it most commonly applies to grandchildren of Spanish nationals—though children and even great-grandchildren may also qualify, depending on the circumstances.

Who Is Eligible for Spanish Citizenship Under the Grandchildren’s Law?

You may qualify for Spanish nationality under one or more of the following categories:

1. Descendants of Spanish Exiles

If your parent or grandparent was forced to leave Spain during the 20th century due to political, ideological, or religious persecution, and they lost or renounced their Spanish nationality as a result, you may be eligible.

2. Children of Spanish Women Who Lost Citizenship

If your mother or grandmother was a Spanish citizen who lost her nationality by marrying a non-Spanish national before 1978, you may be eligible to reclaim citizenship.

Before Spain’s 1978 Constitution, women who married foreigners often lost their nationality automatically. This law seeks to correct that historical gender-based injustice.

3. Children of Individuals Naturalized Under Previous Laws

If your parent obtained Spanish nationality under the Historical Memory Law of 2007 or the current Democratic Memory Law, and you were over 18 at the time of their naturalization, you may also apply for Spanish citizenship now.
